Terms & Conditions
Cybersite Hosting reserves the right to change this Policy any time, so please, check this page at least once a month or when in doubt.
The Customer consents to and agrees that Cybersite reserves the sole right to assign this Agreement and all rights and obligations of Cybersite contained herein if the assignee agrees to be bound by or assume the obligations imposed on Cybersite under this Agreement. Customer shall not assign this Agreement to any other party.
Cybersite Hosting strives to provide the best possible service to all our customers, but we will not tolerate any unlawful activity or abuse on our servers. We respect freedom of speech and expression unless it is harmful to others. These brief guidelines are imposed to protect you, other Cybersite Hosting customers and us against such harm.
Advertisement of the merchants shall be legal, decent, honest and truthful and shall comply with the requirements of the current legislation in force in their respective countries. The following contents shall not be allowed:
Public Security and National Defence
- Contents which jeopardise public security or national defence.
- Contents which undermine the public confidence in the administration of justice.
- Contents which present information or events in such a way that alarms or misleads all or any part of the public.
- Contents which tend to bring the Government into hatred or contempt, or which excite disaffection against the Government.
Racial and Religious Harmony
- Contents which denigrate or satirise any racial or religious group.
- Contents which bring any race or religion into hatred or resentment.
- Contents which promote religious deviations or occult practices such as Satanism
Public Morals
- Contents which are pornographic or otherwise obscene.
- Contents which propagate permissiveness or promiscuity.
- Contents which depict or propagate gross exploitation of violence, nudity, sex or horror.
- Contents which depict or propagate sexual perversions such as homosexuality, lesbianism and paedophilia.
Non-Publication / Payment
Cybersite Services Pte Ltd reserves the right not to host any or all the advertising items requested by the Applicant without giving any reason whatsoever to the Applicant notwithstanding anything any entries that may appear in this application, the copy slide, the showproof and, or the visual presentation. If payment is tendered with this application and Cybersite Services Pte Ltd does not publish any or some of the advertising items requested in this application, a refund will be made to the extent of the advertising item(s) not published.
If there are outstanding sums due and payable by the Applicant to Cybersite Services Pte Ltd is entitled to refuse to insert any / all of the advertising items without notice to the Applicant.
If the Applicant has been permitted to effect payment on an agreed basis, failure to effect any one such payment shall forthwith entitle Cybersite Services Pte Ltd to demand and collect the entire balance in one lump sum.
The Applicant, warrants that in respect of any subscription submitted for publication which contains the name or pictorial representation (photographic or otherwise) of any living person and /or any part of a living person and / or any copy by which any living person is or can be identified the Applicant has obtained the authority of such living person to make such use of such name, representation and /or copy as is made in the said advertisement and in the event of any demand claim or criminal charges against Cybersite Services Pte Ltd arising from the publication of the advertisement, the Applicant will indemnify Cybersite Services Pte Ltd from any costs, damages, fines, penalties or other charges falling upon Cybersite Services Pte Ltd as a result of such demand claim of criminal charge.
The Applicant, warrants that nothing whatsoever shall be included in the publication which shall constitute a breach or infringement of any copyright, trademark, trade name or intellectual property rights owned by any third party or which shall be in any way illegal scandalous or libellous and the Applicant will indemnify Cybersite Services Pte Ltd against any liability in respect thereof and shall pay all costs and expenses which may be incurred by Cybersite Services Pte Ltd in reference to any such claim.
The Applicant hereby irrevocably and unconditionally undertakes to indemnify Cybersite Services Pte Ltd in full and keep Cybersite Services Pte Ltd fully indemnified against loss, damages (consequential, direct or indirect), liabilities, fines, penalty, costs and expenses, whatsoever which Cybersite Services Pte Ltd may sustain or incur as a result of inserting or publishing the advertisement of the Applicant or enforcing its rights pursuant to or under this Applicant.
Goods and Services Tax The Applicant shall be liable for payment for any Goods and Services at such prevailing rates as may be prescribed by Parliament and which may be amended from time to time by the relevant authorities.
The Applicant hereby acknowledges and agrees that by signing this application he/she has contracted with Cybersite Services Pte Ltd on all terms and conditions set out herein.
Payment on issue billing is due on the first day of the year of publication of the advertisement. Notwithstanding this, Cybersite Services Pte Ltd shall, AT ANY TIME, without any cause or reason whatsoever, have the right to require full payment of all sums due and payable in one lump sum as a condition for acceptance of this application.
No refund for early termination.
Any refunds will be given at the discretion of the Company Management.
SPAM / Email Policies
Cybersite Hosting is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either: Over the Cybersite Hosting network, by customers or any other users of the Cybersite Hosting network (including customers’ customers); AND/OR over ANY network- if the message sent advertises or mentions a site hosted on the Cybersite Hosting server.
We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy.
Spamming is the sending of unsolicited e-mail, regardless of size or volume, to persons the sender does not know or have prior consent to send the message to. Using fictitious e-mail addresses @Cybersite or any domain name hosted with Cybersite is strictly forbidden. Spamming also includes sending unsolicited advertisements to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user. A violation of this policy extends to clients who send unsolicited e-mail from a domain name not affiliated or hosted with Cybersite but the mail message makes mention of a website hosted with Cybersite.
Cybersite allows clients to send mailings to subscribers of their own mailing list. Such mailings must have explicit instructions to the recipient on how to remove his/her name from the list, and all requests to do so must be honored immediately. Client agrees not to send mailings to lists provided by an outside agency or individual. Client further agrees not to provide mailing list services to others. Due to the nature of a shared-server environment, Cybersite requests that mailing lists be sent during non-peak hours, specifically between the hours of 1:00 am and 5:00 am, Central Time. Cybersite reserves the right to terminate a client’s mailing program, whether provided by Cybersite or not, immediately and without notification to client if said list causes a problem with the e-mail services of other clients. Cybersite also reserves the right to forbid a client from utilizing any mail-sending program that jeopardizes the mail services of other clients.
Providing spam ware or spam related programs is strictly prohibited. Additionally, clients may not have e-mail lists available for download on the site.
Due to the consumption of system resources and overloading of the e-mail server, Cybersite forbids the use of the Gossamer Links program by any client.
Trolling, the posting of outrageous messages to generate numerous responses, is also not allowed. Mail bombing, the sending of multiple messages without significant new content to the same user and/or subscribing someone else to a mailing list without that person’s permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system is strictly forbidden. Cybersite reserves the right to determine what constitutes abuse of this policy. Clients whose accounts are found in violation of this policy may, at the discretion of Cybersite, have their account(s) terminated without notice and are not subject to any disbursement or refund for the violations. Sites closed for violations of this policy will not be reinstated under any circumstance.

Content Policy
All services provided by Cybersite may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of Singapore law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless Cybersite from any claims resulting from the use of the service which damages the subscriber or any other party.
Pornography and sex-related merchandising is prohibited on all Cybersite Hosting servers. This includes sites that may infer sexual content, or links to adult content elsewhere. Cybersite Hosting will be the sole arbiter in determining violations of this provision.
Also prohibited are sites that promote any illegal activity or present content that may be damaging to Cybersite Hosting servers or any other server on the internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
* Pirated software
* Hacker programs or archives
* Warez sites
Cybersite Hosting will be the sole arbiter as to what constitutes a violation of this provision.
Cybersite Hosting does not host sites of its competitors or web pages promoting sites of its competitors.
Back-Up Files
Cybersite Hosting provides FTP login information needed for web maintenance and data back-up. It is the responsibility of the customer to keep up-to-date archives of their data back-up. Cybersite Hosting does not back-up, or keep records or copies of our client’s web content under shared hosting service . Therefore, Cybersite Hosting will not be responsible for any loss of data.
Cybersite Hosting does not provide data backup services to customer under unmanaged dedicated server hosting. It is the responsibility of the customer to keep up-to-date archives of their data back-up.
Email Policy
Cybersite Hosting may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Your email account may not be referenced as originator, intermediary, or reply-to address of such email. We consider mass email any email message sent to more than 25 email addresses or more than 10 news groups.
Copyright Policy
It is the responsibility of the client to ensure that all information within their account is their own work. Due to distribution rights of shareware programs, clients may not distribute freeware software programs unless the programs are their own work. Copyrighted materials include art, music and other works. MP3 is a popular file format for encoding music. While we do not ban MP3s, we do ask that any MP3s you have on your website are not in violation of any copyrights. Copyrighted music, in any format, cannot be placed within client’s account. Clients agree to indemnify Cybersite of any possible litigation involving trademark or copyrighted materials.
Client agrees not to modify any copyright notices in features (Perl programs, etc.) provided by Cybersite. Modification of scripts provided by Cybersite without written permission is strictly prohibited.
CGI/PHP/ASP Scripts Usage Policy
Each account comes with its own ‘cgi-shl’ folder and you are free to use any CGI scripts. However, these scripts must used low system resources and any malicious scripts found are subject to immediate removal and account cancellation. We reserve the right to disable any scripts that effects normal server operation or service to other Cybersite Hosting customers.
- Excessive Usage
Client agrees to take all responsibility for all programs including CGI scripts executed under their account. Programs that consume an excessive amount of CPU run time or Random Access Memory (RAM) are not permitted. Client agrees and understands that such excessive use can have an adverse effect on the performance of the web server. Client agrees to accept responsibility for programs executed under his/her account, regardless of who authored the program. Cybersite reserves the right to suspend accounts without notice to clients who violate these terms. Cybersite has sole discretion over what constitutes excessive usage. - Flat File Database Driven Forums
Due to the use of flat files instead of databases, Cybersite does not allow the use of UBB or YABB bulletin boards. These boards takes up too much system resources, results in system performance degradation, and cannot be allowed in our shared server environment. We recommend using VBulletin or phpBB as a more efficient, database-driven alternative to these bulletin boards. However, busy sites with large forums and databases are also not suitable to be in a shared server environment. - Cron Jobs
Cybersite does not allow background Daemons such as IRC bots; eggdrop; BitchX; XiRCON; and any other program that interferes with normal server operation. - IRC
Cybersite does not allow IRC or IRC bots to be operated on our servers.
Sub-Hosting Policy
Sub-hosting (hosting more than one web site with a single Cybersite Hosting user account) is generally not allowed on Cybersite Hosting servers. It is subject to Cybersite Hosting approval on case by case basis.
Indemnity Policy
You agree to use all Cybersite Hosting services and facilities at your own risk. Cybersite Hosting specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Cybersite Hosting be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Cybersite Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Cybersite Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Cybersite Hosting against liabilities arising out of; any injury to person or property caused by any products sold or otherwise distributed in connection with Cybersite Hosting’s server; any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; copyright infringement and any defective products sold to customer from Cybersite Hosting’s server. Cybersite Hosting shall be the sole judge of what violates this Policy
Assignment
The Customer cannot assign or novate, or otherwise dispose of your rights, interests, burdens, liabilities or obligations under the “Terms and Conditions” whether in whole or in part without the prior written consent of Cybersite Services Pte Ltd.
Cybersite Services Pte Ltd may assign or novate, sub-contract, or otherwise dispose of our rights, interests, burdens, liabilities or obligations under the “Terms and Conditions” whether in whole or in part to our Affiliate Company or third party with the prior written notice to the Customer.
The Customer acknowledges and agrees that the obligations of Cybersite Services Pte Ltd under this “Terms and Conditions” may be performed by other companies nominated or engaged by Cybersite Services Pte Ltd. Cybersite Services Pte Ltd shall further have the rights to sub-contract any of our obligations to any third party.
Customer’s Responsibilities
Customer’s Content. You are solely responsible for the development, content, operation, maintenance, and use of Your Content. You are solely responsible for:
a) The technical operation of Your Content, including ensuring that calls You make to any Service are compatible with then—current APIs for that Service;
b) Compliance of Your Content with the Acceptable Use Policy, the other Policies, and the law;
c) Claims relating to Your Content; and
d) Properly handling and processing notices sent to You (or any of Your affiliates) by any person claiming that Your Content violate such person’s rights, including notices pursuant to the Digital Millennium CopyrightAct.
